A. Allgemeines

A.General Points

Art. 1 Umfang des Vertrages

Art. 1 Scope of the Contract

1.1Der einzelne Vertrag besteht aus den folgenden Vertragsbestandteilen in der folgenden Reihenfolge, die bei Widersprüchen gilt:

1.1Each contract is comprised of the two following and integral parts, which shall apply in the event of contradictions in the following order:

1.1.1die individuellen Vereinbarungen zwischen dem Gast (Auftraggeber) und dem Bergführer (Beauftragter);

1.1.1Individual agreements between the client (principal) and the guide (agent)

1.1.2diese Allgemeinen Vertragsbedingungen (abgekürzt mit AVB).

1.1.2These General Terms and Conditions (hereinafter referred to as GTC).

1.2Als Bergführer im Sinne dieser AVB gilt jede Person mit eidgenössischem Fachausweis für Bergführer oder mit einem vergleichbaren Fachausweis für Bergführer, der von der IVBV (Internationale Vereinigung der Bergführerverbände) anerkannt ist. Unter dieser Bedingung gilt als Bergführer im Sinne dieser AVB jede Person, der ein Bergführerauftrag erteilt wird, also die Bergführerin, der Bergführer oder eine Organisation (z.B. einfache Gesellschaft mehrerer solidarisch haftender Bergführer im Sinne von Art. 530 ff. OR oder eine juristische Person wie Kollektivgesellschaft oder Aktiengesellschaft als beauftragte Vertragspartnerin), sofern die beauftragte Organisationen einen oder mehrere Bergführer mit den vorerwähnten Fachausweisen für die Auftragserfüllung einsetzt.

1.2As defined by these GTC, any person having obtained the Swiss Mountain Guide Federal Certificate or any other equivalent certificate recognised by the International Federation of Mountain Guide Associations (IFMGA) shall be considered to be a mountain guide. Any person meeting this criterion shall be considered as a mountain guide as defined by these GTC, if he/she has been entrusted with the mandate of serving as a mountain guide. It may be a man, a woman or an organisation (e.g.: simple partnership formed by several mountain guides jointly and severally liable within the meaning of Art. 530 and following of the Swiss Code of Obligations, or a legal entity such as a general partnership or even a corporation in its capacity as

Ebenfalls als Bergführer im Sinne dieser AVB gelten auch die Bergführeraspirantin und der Bergführeraspirant, soweit sie nach der jeweils geltenden Wegleitung des SBV für Bergführeraspiranten zur selbständigen Führung von Gästen berechtigt sind; sie haben den Gast unaufgefordert und unmissverständlich über ihren Status und ihre beschränkten Befugnisse zur selbständigen Führung von Gästen aufzuklären.

Also considered as mountain guides, as defined by these GTC, are aspiring guides (men and women), provided that they are authorised to accompany clients alone, in compliance with the SMGA directives in effect for aspiring guides, and that they have spontaneously revealed their status to the client without any ambiguity and explained that their capacity to carry out mountain missions with clients in an autonomous manner is limited.

1.3Der einzelne Vertrag (Bergführerauftrag) ist ausschliesslich dem schweizerischen Recht unterworfen, auch wenn der Vertrag ganz oder teilweise im Ausland erfüllt wird. Das schweizerische Recht, insbesondere das Auftragsrecht (Art. 394 ff. OR), ergänzt die in Art. 1.1 hiervor genannten Vertragsbestandteile.

1.3Each contract (mountain guide mandate) is exclusively governed by Swiss Law, independently of the fact that the mission may be carried out in part or in whole in a foreign country. Swiss Law, and notably Mandate Law (Art. 394 and following of the Swiss Code of Obligations) complete the integral parts mentioned in Art. 1.1 of these GTC.

1.4Sofern und soweit das Bundesgesetz über Pauschalreisen vom 18. Juni 1993 (PauRG; SR 144.3) anwendbar ist, besitzen dessen zwingende Vorschriften (vgl. Art. 19 PauRG) Vorrang vor den in Art. 1.1 hier vorgenannten Vertragsbestandteilen und Vorrang vor dem Auftragsrecht (vgl. Art. 1.2 hiervor).

1.4Under the condition and provided that the Swiss Federal Law of 18 June 1993 on Flat Fee Trips (PauRG; SR [Systematic Collection of Federal Law] 144.3) is applicable, mandatory regulations arising therefrom (see Art. 19 PauRG) shall take precedence over the points previously exposed in Art. 1.1 and Mandate Law (see Art. 1.2 of these GTC).

2.2Eine allfällige Auftragsbestätigung des Bergführers oder des Gastes in schriftlicher Form (Brief, Telefax, E-Mail, Telex, Telegramm usw.) erfolgt nur zur beidseitigen Erleichterung des Beweises des Vertragsabschlusses und ist keine Bedingung für die Gültigkeit des Vertragsabschlusses. Wird einer schriftlichen Auftragsbestätigung nicht unverzüglich und schriftlich widersprochen, ist der Inhalt der Auftragsbestätigung für beide Parteien verbindlich.

2.2A possible confirmation of the mandate, in written form (letter, telecopy, e-mail, telex, telegram, etc.), drafted either by the guide or the client, will only serve to allow both parties to prove more easily that the contract exists and in no way constitutes a sine qua non condition of its validity. In the absence of an immediate and written contestation of the written confirmation of a mandate, the content of said confirmation becomes binding on both parties.

2.3Art. 2.1 und Art. 2.2 hiervor gelten nicht, falls eine oder beide Parteien den ausdrücklichen Vorbehalt anbringen, dass der Vertrag nur gültig sein soll, wenn er schriftlich vereinbart wird. Lautet eine solche Formabrede bzw. ein solcher (einseitiger) Formvorbehalt auf Schriftlichkeit ohne nähere Bezeichnung, so gelten für deren Erfüllung auch der Austausch von Briefen, Telefax-Schreiben, E-Mail- Briefen, Telex sowie alle Verfahren, welche die Wiedergabe des Inhaltes in Schriftzeichen ermöglichen.

2.3Art. 2.1 and 2.2 of these GTC shall not apply if one or both of the parties stipulate(s) an express condition, according to which the contract is only valid in written form. In the event of a formal agreement of this type or of a reservation (stipulated unilaterally) providing for a written form without further specifications, a letter, telecopy, e-mail or telex, as well as any other procedure providing for the written forwarding of the agreement!s content shall also apply.

Art. 3 Qualitätssicherung durch den Bergführer

3.1Der Bergführer haftet für die sorgfältige Auftragserfüllung nach dem Wissen und dem Können, die bei einem Bergführer mit schweizerischem Fachausweis vorausgesetzt werden dürfen und müssen, gemäss den gesetzlichen Haftungsbestimmungen.

3.1The guide is responsible for carrying out the mandate with due diligence, in compliance with the knowledge and skills required by the Swiss Mountain Guide Federal Certificate (capacities that the client has the right to expect), in accordance with the legal provisions regarding liability.

3.2Der Bergführer garantiert, dass er im Besitz des schweizerischen Fachausweises für Bergführer ist. Werden mehrere Personen beauftragt, garantieren sie, dass sie alle im Besitze des schweizerischen Fachausweises für Bergführer sind. Befinden sich

3.3Der Bergführer garantiert, dass ein allfälliger weiterer Bergführer, mit dem er einen Untervertrag abschliesst, ebenfalls im Besitze des schweizerischen Fachausweises für Bergführer ist. Mit einer Person, die nicht im Besitze des schweizerischen Fachausweises für Bergführer ist (z.B. Bergführer mit ausländischem Fachausweis oder Bergführeraspirant), darf der Bergführer nur im ausdrücklichen, rechtzeitig eingeholten Einverständnis des umfassend orientierten Gastes einen Untervertrag abschliessen.

3.3The guide guarantees that another possible guide with whom he/she subcontracts has also obtained the Swiss Mountain Guide Federal Certificate. The guide may not be party to a contract with a person lacking the Swiss Mountain Guide Federal Certificate (e.g.: mountain guide certified in another country or aspiring guide) unless he/she has obtained the express agreement of the client. He/she must submit the request in a timely manner to the latter and explain the situation comprehensively.

Art. 4 Qualitätssicherung durch den Gast

4.1Der Gast ist verpflichtet, die Weisungen des Bergführers strikte zu befolgen. Im Widerhandlungsfall ist der Bergführer zum sofortigen Abbruch berechtigt und der Gast zur Bezahlung der vollständigen vereinbarten Vergütung verpflichtet.

4.1The client shall follow the guide!s instructions to the letter rigidly. Should this not be the case, the latter has the right to terminate his/her mandate immediately, and the client shall be bound to remit the full contractual remuneration.

4.2Der Gast ist verpflichtet, den Bergführer von sich aus über allfällige, in seiner Person bestehende Risiken (insbesondere gesundheitliche Risiken) zu orientieren. Ohne gegenteilige Orientierung garantiert der Gast dem Bergführer, dass er über die für die Erfüllung des konkreten Bergführerauftrages erforderlichen Eigenschaften wie Kondition, physische und psychische Gesundheit, Bergerfahrung, Trittsicherheit und Schwindelfreiheit, Ausrüstung usw. verfügt. Erfüllt

4.2The client shall spontaneously inform his/her guide of any possible risks that concern him/her (and specifically of a medical nature). In the absence of contrary indications, the client guarantees to the guide that he/she has the required capacities (physical condition, physical and mental health, mountain experience, sure-footedness, absence of vertigo, equipment, etc.) to undertake the tour covered by the contract. 4.3Der Gast akzeptiert die Risiken, die auch bei einer sorgfältigen Vertragserfüllung durch den Bergführer bestehen.

4.3The client accepts the risks inherent to the tour, independently of the fact that the mandate must be carried out with diligence by the guide.

Art. 5 Versicherungen

Art. 5 Insurance

5.1Der Bergführer bestätigt, dass er eine Haftpflichtversicherung abgeschlossen hat. Der SBV empfiehlt eine subsidiäre Deckungssumme von CHF 10 Mio. pro Unfall für Personen- und Sachschäden. Auf Verlangen des Gastes weist der Bergführer den Bestand seiner Berufshaftpflichtversicherung durch eine Fotokopie der Versicherungspolice nach.

5.1The guide confirms having obtained professional civil liability insurance coverage. The SMGA recommends additional coverage of CHF 10 million per accident, which includes bodily injuries and equipment damage. Upon request from the client, the guide shall provide a photocopy of his/her insurance policy in order to prove that he/she has effectively subscribed to professional civil liability insurance coverage.

Zudem hat der Bergführer die gesetzlich vorgeschriebenen sowie die üblichen Versicherungen abgeschlossen, insbesondere Kranken- und Unfallversicherungen.

Moreover, the guide is covered by the usual and mandatory insurance, notably health and accident insurance.

5.2Es ist Sache des Gastes, in eigenem Namen und auf eigene Rechnung die folgenden (empfohlenen) Versicherungen abzuschliessen:

5.2It is incumbent upon the client to subscribe to the following type of insurance (recommended) in his/her name and for his/her own account:

!Vertragsrücktrittsversicherung, auch Annullationskosten- Versicherung genannt (vgl. Art. 5 lit. e PauRG);

!Insurance in the event of withdrawal from the contract, also called cancellation fee insurance (see Art. 5, paragraph e of the PauRG)

!Kranken- und Unfallversicherung;

!Health and accident insurance

!Versicherung der Such-, Bergungs- und Rückführungskosten bei Unfall oder Krankheit, sofern und soweit diese Versicherung nicht bereits in den Kranken- und Unfallversicherungen eingeschlossen ist (vgl. auch Art. 5 lit. e PauRG);

!Insurance covering search, rescue and repatriation costs in the event of accident or sickness, provided that these clauses are not already included in the health and accident insurance (also see Art. 5, paragraph e of the PauRG)

!Haftpflichtversicherung mit Einschluss von Bergunfällen.

!Civil liability insurance including mountain accidents.

Art. 6 Gerichtsstand

6.1Für die Beurteilung allfälliger Streitfälle aus dem Bergführervertrag sind die ordentlichen Gerichte zuständig.

6.1In the event of a dispute arising from the mountain guide contract, ordinary courts of law shall be competent.

6.2Die Vertragsparteien vereinbaren den Wohnort des Bergführers als ausschliesslichen Gerichtsstand.

6.2Parties to the contract agree that the guide!s domicile shall be the exclusive place of jurisdiction.

7.2Das Honorar besteht entweder in einem Tageshonorar bzw. mehreren Tageshonoraren (vgl. Art. 9 ff. hiernach) oder in einem bzw. mehreren Gipfelhonoraren (vgl. Art. 14 ff. hiernach).

7.2Fees correspond to either one or more per-diem flat rates (see Art. 9 and following of these GTC), or one or more flat rates per summit (see Art. 14 and following of these GTC).

7.3Sofern und soweit der Bergführer mehrwertsteuerpflichtig sein sollte, ist die Mehrwertsteuer sowohl im Tageshonorar als auch im Gipfelhonorar nicht inbegriffen und darf vom Bergführer zusätzlich in Rechnung gestellt werden.

7.3If the guide is subject to VAT, this tax is not included either in the per-diem rate or in the rate per summit. Consequently, he/she may add it to the invoice.

Art. 8 Vereinbarung der Vergütung

Art. 8 Remuneration Agreement

8.1Bergführer und Gast sollen die Vergütung des Bergführers, insbesondere sein Honorar, bei Vertragsabschluss fest vereinbaren (vgl. auch Art. 2.2. hiervor betreffend Auftragsbestätigung). Die vom SBV empfohlenen Tageshonorare und die publizierten Gipfelhonorare sind unverbindliche Empfehlungen (Richtpreise).

8.1The guide and the client must agree on the guide!s remuneration, and specifically on his/her fees (also see Art. 2.2 of these GTC relative to the mandate confirmation), when finalising the contract. The per diem fees recommended by the SMGA, as well as the flat rates per summit published are non- binding recommendations (indication prices).

8.2Unterlassen es die Vertragsparteien, bei Vertragsabschluss die Vergütung zu vereinbaren, so schuldet der Gast dem Bergführer das bzw. die Tageshonorare gemäss Art. 9 ff. hiernach zum subsidiären Tageshonorar gemäss Art. 10.1, Art. 10.2 sowie Art. 11 hiernach zuzüglich den Ersatz der Nebenkosten gemäss Art. 17 ff. hiernach.

8.2If the parties fail to set the guide!s remuneration when finalising the contract, the client shall pay the per diem fee(s) in accordance with Art. 9 and following of these GTC, at the subsidiary flat rate set in Art. 10.1, 10.2 and 11 of these GTC, plus reimbursement of ancillary expenses in accordance with Art. 17 and following of these GTC.

!Difficulty and length of the tour, weather conditions, etc.

!Persönliche Verhältnisse des Gastes (Gesundheit, Alter, Erfahrung usw.);

!Client!s capacity (health, age, experience, etc.)

!Zeitpunkt des Vertragsabschlusses; je kurzfristiger der Vertragsabschluss erfolgt, desto höher ist das Tageshonorar;

!Effective date of contract: the earlier the contract is signed, the lower the per diem flat rate will be.

!Anzahl der Touren- bzw. Kurstage (exkl. Hin- und Rückweg); für eine Vertragsdauer von bloss einem, zwei oder drei Tagen ist ein höheres Tageshonorar angemessen als für ein Engagement des Bergführers für vier und noch mehr Tage.

!Number of days for the tour or training (not including return travel); a higher per diem flat rate shall be applied for a one, two or three-day contract than for one of four days or more.

Art. 10Subsidiäres Tageshonorar

10.1Vereinbaren die Parteien kein bestimmtes Honorar bzw. überhaupt kein Honorar (vgl. auch Art. 8.2 hiervor), beträgt das Tageshonorar CHF 450.-.

10.1If the parties do not agree on a specific fee or do not set fees at all (see also Art. 8.2 of these GTC), the per diem flat rate shall be CHF 450.00

10.2Mangels einer besonderen Vereinbarung der Parteien gilt dieses subisidiäre Tageshonorar auch für die Honorare gemäss Art. 11 - Art. 13 hiernach sowie gemäss Art. 15 und Art. 16 hiernach.

10.2If the parties do not agree on a specific price, the subsidiary per diem flat rate shall also apply for the fees stipulated in Art. 11 to 13, as well as in Art. 15 and 16 of these GTC.

Art. 11Hinweg und Rückweg

Art. 11Return Trips

11.1Sofern der Hinweg (Anreise mit einem Verkehrsmittel und/oder Fussmarsch) am Vortag nach 13.00 Uhr beginnt, schuldet der Gast für diesen Tag die Hälfte des subsidiären Tageshonorars gemäss Art. 10.1 hiervor. Beginnt der Hinweg am Vortag vor 13.00 Uhr, schuldet der Gast das volle subsidiäre Tageshonorar gemäss Art. 10.1 hiervor.

11.1If the outbound trip (arrival by transport and/or approach on foot) begins on the previous day after 1:00 pm, the client shall remit one half of the subsidiary per diem flat rate set in Art. 10.1 of these GTC. If the outbound trip begins on the previous day before 1:00 pm, the client shall remit the full subsidiary per diem flat rate in accordance with Art. 10. of these GTC.

11.2Endet der Rückweg (Fussmarsch und/oder Reise mit einem Verkehrsmittel) am Nachtag vor 12.00 Uhr, schuldet der Gast die Hälfte des subsidiären Tageshonorars gemäss Art. 10.1 hiervor. Endet der Rückweg am Nachtag nach 12.00 Uhr, schuldet der Gast für den Nachtag das volle subsidiäre Tageshonorar gemäss Art. 10.1 hiervor.

11.2If the return trip (on foot and/or by transport) ends on the day after the tour before 12:00 noon, the client shall remit one half of the subsidiary per diem flat rate set in Art. 10.1 of these GTC. If the return trip ends on the following day after 12:00 noon, the client shall remit, as payment for the day following the tour, the full subsidiary per diem flat rate in accordance with Art. 10. of these GTC.

11.3Der Hinweg beginnt am Ort der unmittelbaren Verfügbarkeit des Bergführers (z.B. Wohnort, saisonaler Aufenthaltsort oder Endpunkt des letzten Rückweges), während der Rückweg am Ort der nächsten unmittelbaren Verfügbarkeit des Bergführers endet (z.B. Wohnort, saisonaler Aufenthaltsort oder Ort des Beginns des Hinweges für die Erfüllung des nächsten Auftrages).

11.3The outbound trip starts at the place of immediate availability of the guide (e.g.: domicile, seasonal residence or point of arrival of the return leg of the preceding tour), while the return trip ends on the next place of immediate availability of the guide (e.g.: domicile, seasonal residence or point of departure of the outbound trip of the next mandate).

c)wenn der Gast seinerseits die Tour abbricht;

d)wenn der Bergführer den Abbruch aus dem in Art. 4.1 hiervor genannten Grund verfügt;

d)When the guide decides to stop the tour due to reasons stated in Art. 4.1 of these GTC.

e)wenn der Bergführer eine begonnene Tour abbricht, um in Not geratenen Berggängern zu helfen, wozu er nur ohne Gefährdung seiner eigenen Gäste verpflichtet und berechtigt ist.

e)When the guide stops a tour that has started in order to provide assistance to trekkers in difficulty, because he/she is duty-bound and authorised to do so, on the condition that this involvement does not imperil the safety of his/her own clients.

Anmerkung: Dass der Gast den Bergführer auch dann voll zu bezahlen hat, wenn dieser anderen in Not geratenen Berggängern hilft, ist in der Gefahrengemeinschaft aller Bergsteiger begründet. Jeder Gast darf seinerseits damit rechnen, dass andere Bergführer ihm selber und seinem eigenen Bergführer helfen würden, falls sie selber in Not geraten sollten.

Note: The client!s obligation to remit the entire remuneration to the guide when the latter provides assistance to trekkers in difficulty is legitimate in the community of risks of all mountain climbers. On his/her part, each client may count on the assistance of other professionals of the mountain if his/her guide and the client himself/herself should be in difficulty.

13.2Muss ein mehrtägiges Engagement abgebrochen werden, so ist Art. 13.1 hiervor sinngemäss anwendbar.

14.1Anstelle der Vergütung zum Tageshonorar können die Parteien die Vergütung zum Gipfelhonorar vereinbaren.

14.1Instead of per diem flat rate remuneration, the parties may agree on remuneration in the form of a flat rate per summit.

14.2Richtpreise für die Vereinbarung von Gipfelhonoraren sind die Gipfelhonorare, die von den Kantonen bzw. von regionalen und kantonalen Bergführervereinen für das Gebiet der betreffenden Tour publiziert werden.

14.2The prices published by cantons or regional and cantonal mountain guide associations serve as indication prices to determine flat rates per summit for the area where the tour covered by the mandate will be held.

14.3Mit dem Gipfelhonorar wird die Besteigung eines bestimmten Gipfels mit einem Gast ab einem definierten Ausgangspunkt (z.B. Hütte) über eine definierte Route (z.B. Ostgrat) vergütet.

14.3The flat rate per summit remunerates the ascent of a given summit with a client from a specific departure point (e.g.: a shelter) and following a specific route (e.g.: the East Ridge).

14.4Das publizierte Gipfelhonorar versteht sich für einen einzigen Gast. Der Bergführer ist berechtigt, für jeden weiteren Gast einen Zuschlag von 10 bis 20 % des Gipfelhonorars, jedoch einen maximalen Zuschlag von 50 % geltend zu machen. Für die Bemessung des Zuschlages innerhalb des Rahmens von 10 % bis 20 % sind der Schwierigkeitsgrad und die Länge der Tour massgebend.

14.4The flat rate per summit published is only valid for a single client. The guide has the right to require an additional 10 to 20% of the flat rate per summit for each additional client, not to exceed a maximum additional charge of 50%. The degree of difficulty and the length of the tour are essential in the calculation of the additional charge within a range of 10 to 20%.

Art. 15Hinweg und Rückweg

15.1Für die Vergütung des Zeitaufwandes für den Hinweg und für den Rückweg gelten die Bestimmungen gemäss Art. 11 hiervor.

15.2Mangels besonderer Vereinbarung eines Tageshonorars wird das für Hinweg und Rückweg geschuldete zusätzliche Honorar aufgrund des subsidiären Tageshonorars gemäss Art. 10.1 hiervor berechnet.

15.2Should a specific agreement on a per diem flat rate not exist, the additional flat rate due for return trips shall be calculated on the basis of the subsidiary per diem flat rate set in Art. 10.1 of these GTC.

16.1Es gelten sinngemäss die Bestimmungen gemäss Art. 12 und Art. 13 hiervor.

IV.Nebenkosten

17.1Der Gast schuldet dem Bergführer den Ersatz der effektiven Transportkosten für den Hinweg und den Rückweg sowie allfällige Transportkosten, die während der Vertragserfüllung entstehen (z.B. die Benützung von Transportmitteln wie Bergbahnen usw. für Dislokationen). Zudem trägt der Gast seine eigenen Transportkosten.

17.1The client must reimburse the guide for actual travel expenses for return trips as well as all possible travel expenses incurred during the mandate (e.g.: use of transportation means such as cable cars, etc., when changing sites). Furthermore, the client shall pay for his/her own travel expenses.

17.2Ist die Benutzung öffentlicher Transportmittel unmöglich oder unzumutbar oder können durch die Benutzung des Privatfahrzeuges des Bergführers Hinweg und Rückweg verkürzt werden, besitzt der Bergführer Anspruch auf eine Entschädigung von Fr.-.60 pro einfachen Kilometer, unabhängig davon, ob Gäste mitfahren oder nicht. Wird aus einem der vorgenannten Gründe oder auf Wunsch des Gastes ein Taxi oder ein vergleichbares privates Transportmittel benutzt, gehen die dadurch verursachten Kosten ebenfalls zulasten des Gastes.

17.2If it is impractical, or even impossible to use public transportation links or in the event the use of the guide!s personal vehicle allows to shorten return trips, the guide has the right to request an indemnity of CHF 60.00 per kilometre, independently of the fact that he/she is accompanied by the client or not. If, for one of the above-mentioned reasons or upon request by the client, a taxi service or similar private transportation means are called, expenses incurred are also for the client!s account.

Art. 18Übernachtung

18.1Der Gast trägt auch die effektiven Kosten der Übernachtungen des Bergführers (z.B. in Hütten und Hotels usw.) sowie seine eigenen Übernachtungskosten.

18.1The client also pays for the guide!s actual lodging expenses (e.g.: in shelters and hotels, etc.) as well as his/her own lodging expenses.

Art. 19Verpflegung

Art. 19Food

19.1Die Kosten der Verpflegung des Bergführers und des Gastes in Hütten, Hotels, Restaurants usw., je zuzüglich Getränke und Marschtee, trägt der Gast.

19.1The guide!s and the client!s eating expenses in shelters, hotels, restaurants, etc., plus the price of beverages and tea for the flask are for the client!s account.

19.2Für die Zwischenverpflegungen des Bergführers und des Gastes auf der Tour je aus dem eigenen Rucksack sind beide je selber auf eigene Kosten besorgt.

19.2Possible snacks eaten by the guide and the client during the tour and taken out of each party!s knapsack are to be provided individually by the parties at their own expense.

Art. 20Ausrüstung (Material)

20.1Die Kosten des Bergführers für die eigene Ausrüstung (Anschaffung, Unterhalt und Reparaturen usw.) werden durch das Honorar abgegolten.

20.1The guide!s expenses relative to his/her equipment (purchase, maintenance, repairs, etc.) are included in the fees remitted.

20.2Der Bergführer darf voraussetzen, dass der Gast über die für die Vertragserfüllung erforderliche eigene Ausrüstung verfügt. Ist besonderes Material erforderlich, gibt dies der Bergführer dem Gast rechtzeitig bekannt.

20.2The guide has the right to expect the client to have his/her own equipment available necessary to carry out the mandate. If specific equipment is required, the guide shall inform the client in a timely manner.

20.3Verfügt der Gast nicht über die erforderliche eigene Ausrüstung, vermietet sie ihm der Bergführer auf Verlangen des Gastes zu den Selbstkosten, sofern und soweit dies für den Bergführer möglich und zumutbar ist.

20.3If the client does not have the equipment required, the guide may rent it to the client, upon request and at cost price, provided and on the condition that this operation can be reasonably expected from the mountain guide.

V.Fälligkeit

Art. 21Determination of Payment Terms

21.1Beim Vertragsabschluss ist die Fälligkeit der Vergütung des Bergführers für Honorar und für den Ersatz der Nebenkosten zu vereinbaren und, ob der Gast die Übernachtungs- und Verpflegungskosten (nach Massgabe der Art. 17 ff. hiervor) neben seinen eigenen Übernachtungs- und Verpflegungskosten direkt zu bezahlen hat.

21.1The date on which the guide!s remuneration must be remitted (the latter includes the fees and reimbursement of ancillary expenses) must be set when finalising the contract. In the same manner, whether the client must pay for lodging and eating expenses directly must be determined (in accordance with Art. 17 and following of these GTC), in addition to his/her own lodging and eating expenses.

21.2Der Bergführer ist berechtigt, vom Gast zu verlangen, dass dieser bis zu einem bestimmten Termin vor Beginn der Vertragsdauer eine bestimmte Anzahlung zu leisten hat. Eine solche Vereinbarung kann mit der aufschiebenden Bedingung verbunden werden, dass im Fall der nicht rechtzeitigen Leistung der Anzahlung der Vertrag für beide Vertragsparteien nicht rechtwirksam wird.

21.2The guide has the right to request a down-payment from the client at a given date prior to carrying out the mandate. Such an agreement may include a suspensive provision stipulating that in the absence of remitting the down-payment within the deadline established, the contract becomes null and void for both contracting parties.

Art. 22Keine Vereinbarung der Fälligkeit

22.1Ohne Vereinbarung der Fälligkeit ist der Gast verpflichtet, das Honorar und den Ersatz der Nebenkosten innerhalb von zehn Tagen nach Erhalt der Abrechnung des Bergführers auf das von ihm bekannt gegebene Postcheck- oder Bankkonto zu bezahlen.

22.1In the absence of any set payment terms, the client shall reimburse the fees and ancillary expenses within 10 days of receiving the guide!s invoice on the bank or postal checking account indicated by the latter.

22.2Die Abrechnung kann dem Gast bei Vertragsende in handschriftlicher Form übergeben werden. In diesem Fall beginnt die zehntägige Zahlungsfrist ab Übergabe einer solchen Abrechnung zu laufen.

22.2The invoice may be given to the client at the end of the mandate in handwritten form. In this case, the payment period of ten days comes into effect upon delivery of said invoice.
